No that's not a problem. It's better! It's using a 30-amp where you need a 40-amp that is the problem. That puts more current through the contacts than they are rated for. You're putting less current through them so you are safe with regard to that issue. You might consider using an electrician if you're not sure about something like that.

That is all it is.If you know how to use it, then it works good If you don't know how or are not qualified, don't do it yourself! It's not safe for you to do it if you don't know what you are doing!
