will these airpods pair to an android smart phone without the phone being activated? my wife uses the device to listen to audio books.

I don't believe so. The phone has to approve the pairing too.

One (right) earbud has a near-constant crackling noise. Is there any solution for this? If not, is a replacement earbud set possible? Please advise.

It sounds like an internal wire connection to me. I don't think it is BT related. Well worth trying to get a replacement. Good luck.
