Q: If I used this jerry can for my ATV would the can explode due to it being in the sun all the time and being shaken up while off-roading?

Yes. Mine busted at the seam in my saddlebag. Wasn't in the direct sun and wasn't all that hot the day it split. Sad thing is the owner said he would replace it.....it's been months and I still haven't seen a replacement.

Q: Does this have to be standing upright or can it be safely laid on its side with no leaks?

Mine hasn't leaked, but I wouldn't put it on its side either.

Q: Is the upside down spout required for a tight seal or can that be removed until use?

Yes it most certainly is, if the spout is removed it can and will leak. Please keep the all pieces in tact during storage or active use.
