I ordered an extra large for my hubby, who’s a 36 and had to return it for a large. I think you would be happy with extra large for your size.

Q: I know it says that these are not overpants... but is it possible to wear them as overpants? Or would they be overly tight?

I have a pair and I am quite skinny (5' 10" and 130 lbs) so I ordered small/tall (because if I get the 34" inseam instead of my regular 32" inseam, they cover all the way to the top of my boots when I'm sitting on the bike. The 32" are 2" above my ankle) and I can put summer-weight jeans under them with no problem at all. Not tight or uncomfortable.

Q: Do these pants melt easily if a cigarette goes rogue?

I would say if you get it off in about 3 seconds you'll be fine but to the cigarette holder all I'd advise is to keep hold on to it good lol. Pants aren't kevlar but seem pretty resistant to minor advesaries for a moment.
